Article 1: Creating Comic service

Creating Comic is a platform designed to allow you to create the comic strip of your dreams without any knowledge of drawing or scriptwriting thanks to cutting-edge tools based on artificial intelligence.

We grant you a non-exclusive right to access and use our services (hereinafter referred to as the "Service"), provided that you comply with our Use Policy, applicable laws and regulations, and any other documentation, recommendations or policies that we make available to you.

The Creating Comic website is accessible free of charge anywhere to any user with Internet access. You are responsible for all costs related to accessing the Service, including hardware, software, and Internet connectivity.

Article 2: Data collection

Texts and images generated in the creation of a comic strip are excluded from this copyright. However, you must own or have permission to use any third-party content you may provide in your comics.

   5. Discrimination or other unlawful or harmful conduct in the provision of employment, employment benefits, credit, housing, other economic benefits, or other essential goods and services;
   6. Unauthorized or unlicensed practice of any profession including, but not limited to, financial, legal, medical/health, or related professional practices;
   7. Health, demographic, or other sensitive personal or private information about individuals without rights and consents required by applicable laws;
   8. Creation of malicious code, malware, computer viruses or do anything else that could disable, overburden, interfere with or impair the proper working, integrity, operation or appearance of a website or computer system;
   9. Creation of content that infringes, misappropriates, or otherwise violates any third-party rights;
   10. To engage in or promote criminal activities such as fraud, hacking, or identity theft;
3. To engage in, promote, incite, facilitate, or assist in the planning or development of activities that present a risk of death or bodily harm to individuals, such as any of the following:
   1. Military, warfare, nuclear industries or applications, espionage, use for materials or activities;
   2. Development, improvement, or manufacture of guns and illegal weapons, weapons of mass destruction (such as nuclear, chemical, or biological weapons), weapons of war (such as missiles or landmines);
   3. Development, improvement or manufacture of illegal drugs and regulated/controlled substances, or any gain of function-related activities with respect to any pathogens;
   4. Any content intended to incite or promote violence, abuse, or any infliction of bodily harm to an individual;
4. To intentionally deceive or mislead others, including use of Creating Comic related to the following:
   1. Generating, promoting, or furthering fraud or the creation or promotion of disinformation;
   2. Generating, promoting, or furthering defamatory content, including the creation of defamatory statements, images, or other content;
   3. Generating, promoting, or further distributing spam;
   4. Impersonating another individual without consent, authorization, or legal right;
   5. Representing or misleading people into believing that the use of Creating Comic or outputs are human-generated;
   6. Generating or facilitating false online engagement, including fake reviews and other means of fake online engagement;
   7. Generating or facilitating large-scale political advertisements, propaganda, or influence campaigns;
5. To fail to appropriately disclose to end users any known dangers of Creating Comic AI system or misrepresent or mislead with respect to its abilities.

We encourage you to report any inappropriate user content that violates this Policy. Reports can be submitted via email to contact@creating-comic.com and should include relevant information to assist in the investigation. We reserve the right to suspend or terminate the accounts of users who repeatedly violate this Policy. Users may request an explanation or appeal a moderation decision by submitting an appeal via email to contact@creating-comic.com for further review.

Article 6: Limitations

As a digital professional, we are doing everything we can to keep the Creating Comic service operational and offer you a unique comic creation experience. The Service may experience temporary interruptions due to technical issues, updates, or third-party service failures. We will work to restore access promptly.

Article 7: Cookies

The site allows creators to publish their comics in the gallery. In your publications, you agree to respect the rules of good conduct of the Internet and the rules of law in force. The site may exercise moderation on publications and reserves the right to refuse to put them online, without having to justify it.

You remain the owner of all your intellectual property rights. However, by publishing in the gallery, you grant us a non-exclusive, royalty-free license to display your comic on the site and promote it on our social media channels. Our publishing company is committed to displaying your username near each use of your publication.

Any content you post on the site is your sole responsibility. You must not upload content that is illegal, obscene, defamatory, or violates third-party rights. Postings of any unauthorized products or content may result in content removal, immediate suspension or termination of your account and a lifetime ban from use of our services. Also, you agree not to harass, threaten, or impersonate other users. Any legal action taken by an injured third party against the site will be your responsibility.

The content you post may be removed or modified by the site at any time and for any reason, without notice.

Article 9: Applicable law and competent jurisdiction

French law applies to these Conditions. In the event of failure to resolve a dispute between the parties amicably, the French courts will have sole jurisdiction to hear the dispute.
